CASE DETAIL

More than 11.7 tonnes of apparel. The export-control issue was 150 warning labels.

A Japan-bound shipment declared as “bras and 18 other items” weighed more than 11.7 tonnes. The rare-earth issue arose from 150 warning labels backed with Tb-containing NdFeB permanent-magnet material, with a regulated-part value of USD 91.34. The export-control portion was ultimately handled as a no-penalty decision; the RMB 2,000 fine in the same record concerned separate declaration irregularities. The case illustrates why the relevant unit of analysis may be a small component inside a much larger shipment.

TECHNICAL BOUNDARY

Writing “magnet” on the declaration is not enough.

In 108 of the 139 cases, the declared product name already indicated a relationship to rare earths, magnets or magnetic materials. The dominant issue is therefore not simply whether the product name was concealed. Export-control status can turn on elemental content, concentration, composition and product form—including Dy, Gd and Tb. The regulatory boundary is often found at the level of material and technical attributes, not in the commercial name alone.

ENFORCEMENT DIFFERENCE

Ningbo 52, Shanghai 42 — why are the outcomes so different?

All 52 rare-earth cases handled through Ningbo in the dataset resulted in formal penalties, while 20 of Shanghai’s 42 cases ended in no-penalty decisions. The gap remains visible within comparable element groups, but the case populations are not identical: median shipment weight differs sharply and product and violation characteristics also vary. The Edition therefore tests the structure behind the difference rather than reducing it to a simple claim that one customs region is “strict” and another “lenient.”
